Terms & Conditions

Please read these terms and conditions (“the Terms”) carefully. By entering our Website, you are deemed to have accepted our conditions of use as set out in the Terms.​

 

Definitions

Buyer means the individual, company or organisation that purchases, buys or agrees to buy the Goods from the Seller via the Website, Telephone or by Letter.

Consumer shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977.

Contract means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions.

Goods means the products and supplies that the Buyer agrees to buy from the Seller.

Seller means Pimpmobility.com, Southampton, England.

Terms and Conditions means the terms and conditions of sale set out in this agreement and any special terms and conditions agreed in writing by the Seller.

Conditions

​Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer.

​These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller (Pimpmobility.com) to the Buyer and shall prevail over any other documentation or communication from the Buyer.

​Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and Conditions.

​Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller. Any complaints should be addressed to the Seller’s address at Pimpmobility.com, 145 Obelisk Road, Southampton, SO19 9DN, England.

 

Ordering

​All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.

​Where the Goods ordered by the Buyer are not available from stock the Buyer shall be notified and given the option to either wait until the Goods are available from stock or cancel the order and receive a full refund within 30 days or purchase other goods to the value of the original order.

​When making an order through the Pimpmobility.com website, the technical steps the Buyer needs to take to complete the order process are described in the Order Process Section.

 

​Price and Payment

​The price of the Goods shall be that which is stipulated on the Pimpmobility.com Website. The price is inclusive or exclusive of VAT. The price does not include delivery charges.

​The total purchase price, including VAT and delivery charges, if any, will be displayed in the Buyer’s shopping cart prior to confirming the order.

After the order is received the Seller shall confirm by email the details, description and price for the Goods together with information on the right to cancel

​Payment of the price plus VAT and delivery charges must be made in full before dispatch of the Goods.

​Goods supplied within the UK will normally be delivered within 7 (Seven) working days of acceptance of order, this timescale may be longer depending on third party delivery companies used. By accepting our terms and condistions you agree that you understand this.

​Goods supplied outside the UK will normally be delivered within 15 (Fifteen) working days of acceptance of order.

​The Seller shall use its reasonable endeavours to meet any date agreed for delivery. In any event time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.

​Delivery of the Goods shall be made to the Buyer’s address specified in the order and the Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.

​By accepting these terms you agree that Pimpmobility.com will send out your order using Hermes and that it is your responsibility to check the tracking number supplied by Hermes for your delivery.

 

​Order Tracking / Delivery

​If Hermes tracking states that they are in ‘process of delivering your item’ you accept that Pimpmobility.com has sent out your order. You also accept that Pimpmobility.com does not guarantee delivery timescales and that Pimpmobility.com has no control over the operations of Hermes and any time scale notifications for product delivery on our website are guides to delivery only.

​Title and risk in the Goods shall pass to the Buyer upon delivery of the Goods.

Rights of Seller

​The Seller reserves the right to periodically update prices on the Website, which cannot be guaranteed for any period of time. The Seller shall make every effort to ensure prices are correct at the point at which the Buyer places an order.

​The Seller reserves the right to withdraw any goods from the Website at any time.

​The Seller shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.

Cancellation

In accordance with the Distance Selling Regulations 2000, the Buyer has the right to cancel their order within 7 working days following the day after the date of delivery for any unused item(s) purchased through the website, for a refund.

If you cancel this contract, we will refund to the Buyer all payments received, excluding any shipping costs. The Buyer has a legal obligation to keep the goods in their possession until they return them to the Seller and to take reasonable care of the goods while they are in the Buyer’s possession. The Seller has the right to make a deduction from the refund for loss in value of any goods supplied, if the loss is the result of careless or unnecessary handling by the Consumer.

The Seller will make the refund without undue delay, and not later than 14 days after the day any goods supplied are returned, or not later than 14 days after the day the Buyer provides evidence that they have returned the goods, or if there were no goods supplied, 14 days after the day on which the Seller is informed about the decision to cancel the contract.

The Seller will make the refund using the same payment method that used for the initial transaction, unless expressly agreed otherwise. No additional fees will be applied to the refund transaction. Any cost of postage for returning unwanted items is the responsibility of the buyer.

Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the Price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatsoever.

Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller’s agents or employees.

 

Returns

Should the Buyer be dissatisfied with any goods received, please contact the Seller using the details provided on the Contact page.

Should the Buyer wish to return an item they will be refunded for any returned item/s in saleable condition (unless it was received by the Buyer in a defective condition – see Defective Goods below) but any refunds may be withheld until the Seller has received the item/s back.

Item/s must be returned to the Seller’s address on the Contact page of this website and the Buyer will have to bear the direct cost of returning the item/s.

It is recommended that item/s are returned using a tracked or signed for service to ensure proof of delivery and insurance for the item/s in transit as the Buyer is responsible for any item/s lost in transit. Refunds will only be made to the card used to purchase the returned item/s. Returns must be made using Hermes drop-off .

 

Defective Goods

The Buyer is requested to examine all goods delivered upon arrival and as far as is possible, to advise carriers representative concerned, at time of receipt, of any apparent damage, shortage or irregularity. Claims for incomplete, damaged or defective goods must be made in writing, using the details on the Contact page of this website, within 48 hours from date of delivery.

In the event of any item being defective in materials or workmanship when delivered the Seller will undertake to replace the item free of charge. The Seller is to be allowed reasonable time to replace any defective item, providing that the item is returned in the state in which it was supplied. The Seller’s liability is limited to such replacement, which shall be deemed a complete fulfilment of the contract. If it is not possible to replace the item, for whatever reason, the Seller shall issue a refund for the defective item. The Seller will pay for the cost of any return shipping of the defective item.

The Seller shall be under no liability whatsoever for any consequential damage, loss or other expenses whether arising out of contract, negligence or otherwise.  The Seller shall be under no liability for defective parts damaged in transit whether due to unsatisfactory packaging or otherwise.

 

Waiver

No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

 

Force Majeure

The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.

 

Severance

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.

 

Changes To Terms

The Seller shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the buyer upon making a purchase.

 

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
